SUPPLEMENTARY REPORT
 
Toowoomba Turf Club - 8 June 2024 and 6 July 2024
Stewards inquired into several social media posts involving Apprentice A. Donald. After taking evidence from Apprentice A. Donald and considering the specifics of the matter, Apprentice Donald subsequently pleaded guilty to two charges pursuant to AR218(4)(c) in that on 8 June 2024 and 6 July 2024, she did use her mobile phone during race-meetings held at Toowoomba Turf Club on the aforementioned dates. Apprentice Donald was subsequently fined the sum of $1000. In assessing penalty, Stewards considered Apprentice Donald’s guilty plea and forthright evidence, however noted one previous breach of the same rule in the preceding 12 months. Apprentice Donald was subsequently advised of her rights to an appeal.

Race 4 FLORENCE & BENCHMARK PINK RIBBON CUP BENCHMARK 58 HANDICAP 1300m
 
COBURG – Trainer K. Kemp subsequently advised that the gelding had been tendered to by the Stable Veterinarian and undergone remedial chiropractic care with the intention now to continue with the preparation after a short let up.
 
GENERAL
 
Apprentice S. Willis pleaded guilty to a charge under the provisions of AR127 in that she did fail to arrive on course by the prescribed time to fulfill her engagement in Race 1 and was subsequently required to be replaced. Apprentice Willis was subsequently fined $100.
 
 
Race 1: RUGBY RACEDAY 2ND NOVEMBER MAIDEN HANDICAP (1400m)
 
MALECON – Raced keenly for some distance near the 800m when the pace slackened. Laid in under pressure in the home straight.
 
STAR ANTHEM – Raced keenly for some distance near the 800m when the pace slackened. Raced wide and without cover for the majority of the event. Laid in under pressure in the home straight.
 
AS EXPECTED – Raced keenly for some distance near the 800m when the pace slackened.
 
THAT KISS – Stewards permitted Apprentice J. Williams to be declared the replacement rider when Apprentice S. Willis failed to arrive on course by the prescribed time. Raced keenly when crossed near the 1200m for some distance. Again raced keenly for some distance near the 800m when the pace slackened.
 
BAGMAN – Took the crossing awkwardly when enroute to the barriers and in doing so dislodged Jockey H. Richardson before being recaptured a short distance later. Jockey Richardson was subsequently examined by QAS officers and deemed fit to fulfill her remaining engagements. The gelding subsequently underwent a pre-race veterinary examination and was passed fit to start. Began awkwardly. Commenced to give ground from the 600m and finished tailed off. A post-race veterinary examination revealed no abnormalities. Trainer K. Afford was advised that the gelding’s nominations would now be restricted to Non-TAB Meetings only until its form improved.
 
PROPHET OF BOOM – Began awkwardly. Improved onto heels near the 700m and obliged to steady.
 
FITASAFIDDLE – Began awkwardly. Jockey M. Hellyer reported that his saddle slipped on jumping placing him at a disadvantage in the early stages resulting in mare losing ground. Raced wide and without cover from the 1000m until obtaining the lead near the 700m. When asked to comment on the tactics adopted on the mare, Jockey Hellyer advised that he was instructed that the mare is better suited when able to be race unimpeded, and not be restrained, and given the ground lost in the early stages, he elected to allow his mount to stride forward and obtain the lead in the middle stages.
 
 
Race 2: BMO MAIDEN HANDICAP (1400m)
 
EL PENSADOR – Began awkwardly. Steadied near the 800m when I WANT THAT MAN laid in. Laid in under pressure in the home straight.
 
BOOM CRUSHER – Began awkwardly.
 
MISS LINNY – Began awkwardly. Raced keenly in the early stages. Laid in under pressure in the home straight. A post-race veterinary examination revealed the mare to have bled from both nostrils for the first occasion. Trainer O. Cairns was subsequently advised of the provisions of AR79(4).
 
PEACH GALANTES – Raced wide and without cover for the majority of the event. Laid in for some distance passing the 550m. Laid in under pressure in the home straight. When asked to comment on the performance, Jockey K. Yoshida advised in his opinion, that the gelding may have reached the end of its preparation.
 
BANKSIA BEACH – Raced keenly in the early stages.
 
SWERVES – Raced wide and without cover in the early stages. Became awkward in its action and faltered before being subsequently eased out of the event near the 500m. An immediate veterinary examination revealed a catastrophic injury to the near-foreleg. The mare was subsequently euthanised on humane grounds.
 
I WANT THAT MAN – Laid in for some distance passing the 800m.
 
BREYTENBACH – Raced keenly in the early stages.
 
ENOLABA – The mare was found to have lost its off-hind plate in running.
 
 
Race 3: OUR LADY OF THE SOUTHERN CROSS MAIDEN PLATE (1000m)
 
DARE TO LOVE – Began awkwardly. Apprentice R. Thorburn was reminded of his obligations under the provisions of AR131(b) to ride his mount out fully to the finish.
 
EVOLEUS – Declared a late scratching at 8:53am on veterinary advice acting from a report from Co-trainer C. Geran that the mare was exhibiting signs of a virus. Trainer C. Geran was subsequently advised a veterinary clearance would be required prior to racing again.
 
HEROIC DESIRE – Raced wide and without cover for the majority of the event.
 
ONATARE – Began awkwardly. Jockey L. Tarrant reported the gelding was inclined to race greenly throughout the event.
 
SPLIT THE CASH – From the wide barrier shifted behind runners in the early stages. Laid in for some distance passing the 800m and obliged to steady off the heels of APOLLO TEN.
 
TWOPENCE – Declared a late scratching at 1:18pm after rearing over and falling in the mounting yard. Prior to the declaration of correct weight all monies invested on the mare were ordered to be refunded with the following deductions to be applied to all successful wagers placed prior to 1:18pm.

12 cents in the dollar for the win
9 cents in the dollar for the place on the winner
9 cents in the dollar for 2nd place
21 cents in the dollar for 3rd place
 
Trainer M. Currie was advised given the mare’s recent history of poor pre-race behaviour, it would now be required to trial under race-day conditions on two consecutive occasions prior to racing again.
 
SOVEREIGN PLACE – Raced keenly in the early stages. Laid in onto heels near the 600m and obliged to be steadied. Raced greenly when placed under pressure in the home straight.
 
Following the running of this race, the track was upgraded to a Good 3.
 
 
Race 4: D&NDJC MAIDEN PLATE (1000m)
 
WHITTAKER – Began awkwardly before shifting out abruptly soon after the start carrying DARK RED wider. Hung-out for some distance passing the 700m. Blundered near the 500m when laying in and away from BECALLMAH.
 
BUN IN THE OVEN – Laid out under pressure in the home straight. Steadied following the winning post when MAKE IT SO shifted in.
 
ELLEYANNA – Shifted in near the 800m to obtain a position with cover when not fully clear of PRINCESS LUTETIA which was obliged to steady. Jockey C. Whiteley was reprimanded under the provisions of AR131(a) for careless riding. Raced keenly in the early stages. Laid in for some distance near the 700m. When asked to comment on the performance, Jockey Whiteley stated that the mare proved disappointing when placed under pressure in the home straight. A post-race veterinary examination revealed no abnormalities.
 
FOR THE BRAVE – Raced wide and without cover the majority of the event. Laid out rounding the home-turn.
 
MAKE IT SO – Shifted in when not fully clear of BUN IN THE OVEN, which was obliged to steady, before continuing into the line of WEATHER, which was obliged to ease passing the winning post. Apprentice L. Martyn was reprimanded under the provisions of AR131(a) for careless riding.
 
PRINCESS LUTETIA – Began very awkwardly. Steadied near the 800m when ELLEYANNA shifted in when not fully clear. Held-up for clear running rounding the home-turn.
 
WEATHER – Steadied passing the winning post when MAKE IT SO shifted in.
 
DARK RED – Obliged to steady soon after the start when WHITTAKER shifted out abruptly and lost ground. Bumped near the 100m when laying in. Shifted in soon after the winning post when not fully clear of LAID BACK BON which was obliged to ease. Apprentice R. Thorburn was advised to exercise greater care.
 
LAID BACK BON – Began awkwardly. Laid out under pressure in the home straight.
 
 
Race 5: TOM FRITH MEMORIAL BENCHMARK 65 HANDICAP (1000m)
 
Correct weight was delayed allowing Jockey M. Wishart and Trainer S. Kirkwood to view the photo finish for fourth. Once satisfied that a margin was present, correct weight was declared on the Judges’ semaphored numbers.
 
TOKYO SINS – Began awkwardly. Laid in for some distance passing the 600m and bumped. Laid in under pressure passing the 300m and bumped again. Raced wide and without cover for the majority of the event. Shifted in under pressure and became awkwardly placed on the heels of MACHINE HEAD, which was also shifting out under pressure. Both Apprentice A. Donald (MACHINE HEAD) and Apprentice D. Bennett were advised to exercise greater care. A post-race veterinary examination revealed no abnormalities.
 
HEROIC CHIEF – Fractious in the barriers prior to the start being effected and lost ground. Jockey W. O’Connell reported as a consequence the gelding settled further back than he had anticipated.
 
MACHINE HEAD – Raced keenly in the early stages. Laid out near the 600m and bumped. Bumped again near the 300m. Shifted out under pressure over the concluding stages.
 
HUSS ON FIRST – Began awkwardly. Raced keenly in the early stages. Laid in for some distance near the 500m crowding LOUD ATTRACTION before being corrected by its rider.
 
NICCI DE ROSA – Raced wide and without cover for the majority of the event. Jockey M. Wishart pleaded guilty to a charge under the provisions of AR131(b) in that she did fail to ride her mount out to the finish, which in the Stewards’ opinion, may have compromised the mare’s chances of finishing third. In assessing penalty, Stewards considered Jockey Wishart’s excellent record in relation to the rule, her guilty plea and forthright evidence throughout the inquiry, however noted her vigour was far below the expected standard. Jockey Wishart was subsequently fined $300. Jockey Wishart was advised of her rights to an appeal.
 
FLICK – Obliged to be steadied and carried wider near the 500m.
 
LOUD ATTRACTION – Crowded and obliged to steady near the 500m when HUSS ON FIRST laid in before being corrected by its rider.
 
Race 6: DARBEY BUILDING & CONSTRUCTION BENCHMARK 58 HANDICAP (1000m)
 
LET’S DANCE JANDY – Laid out under pressure in the home straight. Jockey M. Wishart was reprimanded under the provisions of AR227(a) in that her negligence in weighing out could have led to a breach of AR209(2)(a). In determining penalty Stewards noted that Jockey Wishart had weighed in within the permissible range, but under the gelding’s allotted weight, as well as the general circumstances of the negligence. Jockey M. Wishart was further reprimanded under the provisions of AR131(b) for failing to ride her mount out to the finish. Stewards noted that Jockey Wishart had maintained her second-place finish in the event, however were of the opinion that her vigour was far below the expected standard.
 
ZIN ZAN READY – Began awkwardly.
 
SEA COMMITS – Raced wide and without cover for the majority of the event.
 
THAT'S AN EXTRA – Raced in restricted room for some distance passing the 700m, before being obliged to steady when tightened between LET’S DANCE JANDY and STOP THE ROT.
 
IMPOUNDED – Raced wide and without cover for the majority of the event.
 
DIAMOND WITNESS – Raced keenly in the early stages of the event.
 
NO BETTER AFFAIRE – Raced keenly in the early stages.
 
STOP THE ROT – Began awkwardly. Raced ungenerously in the early stages. Blundered approaching the 300m.
 
ELESPRIT MISS – Began awkwardly and lost ground. Laid in under pressure in the home straight.
 
 
Race 7: PURCELL CIVIL & CONSTRUCTION PLOUGH INN CUP MAIDEN PLATE (1400m)
 
FAST DA – Raced keenly in the early stages. Bumped near the 900m when SNAKESKIN attempted to shift in to obtain a position with cover and became unbalanced.
 
TOMYDONKA – Began awkwardly. Carried inwards near the 800m when SNAKESKIN laid in. Laid out under pressure in the home straight.
 
NEGRONIS – When asked to comment on the performance, Jockey M. Hellyer could offer no explanation, however advised in his opinion that the mare had proved disappointing on both this occasion, and when he had ridden NEGRONIS when it had started as a favoured runner in its previous start. When further questioned regarding the mare leading the event, Jockey Hellyer advised that he had not expected to lead, however after beginning well from the wide barrier and stepping up in distance, the mare had subsequently settled in a more prominent position. A post-race veterinary examination revealed a slow recovery.
 
CRYPT DE PIN – Raced wide and without cover for the majority of the event,
 
TIME TO TURN – Steadied near the 800m when TOMYDONKA was carried inwards by SNAKESKIN to its outside which was laying in despite the efforts of its rider.
 
SNAKESKIN – Began awkwardly. Attempted to obtain a position with cover near the 900m and contacted FAST DA. Laid in for some distance passing the 800m.
 
 
Race 8: LADBROKES DALBY CUP OPEN HANDICAP (1400m)
 
Declaration of correct weight was delayed to allow Stewards to consider an objection from third-placegetters Jockey M. Wishart and Trainer P. Butterworth (SHADYVALE STORM), against first-placegetter (REJOICED) alleging interference in the home straight. After taking evidence from connections and viewing the official patrol footage, Stewards established that approaching the 100m, SHADY VALE SPIRIT had been racing in restricted room to the inside of REJOICED, and when that runner had shifted in marginally, SHADY VALE SPIRIT had eased and altered course to the outside of that runner. However, when considering the matter in its entirety, Stewards were of the opinion that it had not been entirely necessary for SHADY VALE SPIRIT to be shifted to the outside of REJOICED to obtain clear running, and when considering the margin of (1L) between both runners, Stewards could not be comfortably satisfied it had any tangible effect on the finishing order and as such dismissed the protest and declared correct weight on the Judges semaphored numbers.
 
DEVIL'S THROAT – Over-raced throughout the early and middle stages when being restrained to obtain a position with cover. Bumped near the 150m. When asked to comment on the performance, Apprentice J. Williams stated in his opinion, the gelding’s early racing manners proved detrimental to its finishing efforts. He further added that the gelding may not have appreciated the firmer track conditions. A post-race veterinary examination revealed no abnormalities.
 
KORUTO – Raced in restricted room for some distance passing the 900m. Held-up for clear running when awkwardly placed on heels passing the 300m. Bumped near the 150m.
 
REJOICED – Shifted in marginally near the 100m when not fully clear of SHADYVALE SPIRIT. Jockey L. Tilley was advised to exercise greater care.
 
BOLD PEDRO – Began awkwardly. Raced wide and without cover for the majority of the event. When asked to comment on the performance, Apprentice L. Martyn advised in her opinion, that the gelding did not appreciate the firmer track conditions. A post-race veterinary examination revealed the gelding to be lame in the near-foreleg. Trainer G. Taylor was advised a veterinary clearance would be required prior to racing again.
 
TELEPHONE BOOTH – Over-raced for some distance passing the passing the 1000m. Laid in under pressure in the home straight.
 
SELLING SUNSET – Tightened between runners on jumping and lost ground. Raced wide and without cover for the majority of the event.
 
COLLAY'S SPIRIT (NZ) – Began awkwardly.
 
SHADYVALE STORM – Raced in restricted room to the inside of REJOICED for some distance approaching the 100m, before easing and shifting out from that runner’s heels.
 
 
Race 9: CREEK TO COAST CLASS 4 HANDICAP  (1200m)
 
GROOVIN' THE MOO – Began awkwardly. Leaving the 800m, became awkwardly placed on the heels of ESJAY, and shifted out, whilst that runner was shifting in whilst over-racing, and blundered. Shifted in under pressure over the concluding stages when not fully clear of LES GIRLS. Apprentice C. Krahnen was advised to exercise greater care. A post-race veterinary examination revealed lacerations to the near-foreleg consistent with being galloped on.
 
ESJAY – Began awkwardly. Over-raced throughout the early stages when being restrained in an effort to obtain a position with cover near the 800m. Raced keenly when placed in restricted room for some distance thereafter. Held-up for clear running rounding the home-turn. When asked to comment on the performance, Apprentice C. Lowe advised that the gelding is better suited when able to a prominent position and dictate its event. Trainer P. Webster concurred with the opinion of Apprentice Lowe. A post-race veterinary examination revealed no abnormalities.
 
HILL BILLY FLYER – Raced wide and without cover for the majority of the event.
 
THE DEPUTY (NZ) – Slow to begin.

ORPHAN'S TRUST – Raced keenly in the early stages before improving onto heels near the 800m having to be eased. Held-up for clear running rounding the home-turn. Shifted out under pressure over the concluding stages when not fully clear of LES GIRLS. Apprentice J. Williams was advised to exercise greater care.
 
CRAIGLEA ETNA – Began awkwardly and bumped.
 
LES GIRLS – Began awkwardly. Apprentice R. Thorburn dropped his whip near the 100m. Bumped near the 50m. Became awkwardly placed on heels over the concluding stages when GROOVIN’ THE MOO shifted in, and ORPHAN’S TRUST shifted out simultaneously. Apprentice R. Thorburn was severely reprimanded under the provisions of LR48 for leaving the course without permission.
