On arrival at the barriers, LET’S BE MARY (A. Coome) underwent a veterinary inspection after the mare had made contact with the outside running rail leaving the enclosure. LET’S BE MARY was passed to start.
LET’S BE MARY (A. Coome) and BLUE ‘N’ GREY (D. Simmons) were both fractious when placed in the barriers.

TOPANGA (D. Missen) and DANCING RHYTHM (M. Barnham) made contact at the start.
BLUE ‘N’ GREY (D. Simmons) raced wide throughtout.

A post-race veterinary inspection failed to reveal any apparent abnormalities. Trainer D. Stafford could offer no further explanation however stated he intended to retire the filly. While mindful of his intentions, Stewards advised Mr Stafford that a barrier jump-out would be required if the filly was to continue racing to establish it can be competitive.
After being returned to the tie-up stalls and cooling down, EASY NOW showed signs of lameness. A veterinary inspection revealed the gelding to be sore in the near foreleg. Trainer T. Austin advised he intended to have further examinations and treatment. Stewards advised Mr. Austin that a veterinary certificate of fitness would be required prior to its next race start.

Stewards considered an objection lodged by Jockey R. Kerwin, the rider of SPIRIT OF THE BUSH which was placed fourth against HEAD ON IT (D. Brown) being placed third for alleged interference near the 600 metres. After taking evidence from the parties involved, viewing the official video films and taking into account their own observations, stewards upheld the objection when they found that at about the 600 metres HEAD ON IT had shifted in and caused interference to SPIRIT OF THE BUSH. Stewards were of the opinion that the ground lost by SPIRIT OF THE BUSH due to this interference exceeded the margin of a half neck between the two runners at the finish. In the circumstances the protest was upheld and the placings amended to read: 1st EVENING MISS; 2nd DALIONSENN 3rd SPIRIT OF THE BUSH 4th HEAD ON IT. Subsequently Jockey D. Brown pleaded guilty to a charge of careless riding under A.R. 137(a) in that near the 600 metres he permitted HEAD ON IT to shift in when insufficiently clear of SPIRIT OF THE BUSH which had to be checked. Jockey Brown was suspended from riding in races for a period to commence at midnight on 13th February 2010, up to and including midnight on 20th February 2010 (2 Capricornia meetings).
Jockey D. Brown pleaded guilty to a charge under AR 137A (5)(a)(ii) in that, prior to the 100 metres, he used his whip in a forehand manner on more than 5 occasions and was fined $200. Jockey Brown was cautioned under AR 137A (5)(a)(i) for use of the whip in consecutive strides. In determining penalty, Stewards gave consideration to this being Jockey Brown’s first offence.
