Toowoomba Trackwork – Wednesday, 25 September 2024
Stewards inquired into a social media post made by Apprentice L. Sykes during trackwork whilst mounted on a racehorse at the registered training facility of C. & K. Geran on Tuesday, 25 of September 2024. Apprentice Sykes subsequently pleaded guilty of a charge under the provisions of AR113 in that he did use his mobile phone whilst mounted and was fined $200. GENERAL
Race 3 – SUNWORSHIPPER - Stewards inquired into a report from the Compliance Assurance Team following an inspection at the registered stables of Trainer M. Kropp. On inspection, SUNWORSHIPPER presented with a Decron poultice to the near hindleg. After considering the evidence, it was established that the poultice had been applied to aid in the treatment of a minor wound to the near-hindleg. Stewards issued trainer Mr Kropp with a charge under the provisions of AR249(1)(a), in that he did administer a medication to the filly, namely poultice prior to its engagement in Race 3 at Ipswich on Thursday, 26 September. Mr Kropp pleaded guilty to the charge.
In determining penalty stewards took into consideration the following:
• Mr Kropp’s guilty plea
• Mr Kropp’s good record and forthright evidence
• The objective seriousness of the conduct
• The paramount importance of maintaining the integrity of Thoroughbred Racing and ensuring a level playing field for all participants
• Specific and general deterrence principles
• Precedents and general circumstances
In determining penalty, Stewards noted the objective seriousness of charges under AR249, and were of the opinion that special circumstances did exist in this case, and subsequently were able to apply LR117B(c).
Mr Kropp was subsequently fined $1000. He was further advised of his rights to an appeal.
Race 8 – KEWELL – Stewards inquired into a report in relation to KEWELL, following a report from the Compliance Assurance Team that the gelding had been present at a training facility in Oakey, Queensland and not at the registered training location of Mr P. Sexton. Additionally, pre-race blood samples were taken for analysis. Mr Sexton pleaded guilty to a charge under the provisions of AR101(1) in that he did stable the gelding at a premise outside his registered stable location and was subsequently fined $200. Mr Sexton was advised of his rights to an appeal.
Prior to the running of race 7, the mobile phone belonging to Jockey T. Brooker was found to be in her possession in the female’s jockey room. Jockey Brooker pleaded guilty to a charge under the provisions of AR218(4)(b) in that she did have her mobile phone in her possession and was subsequently fined $400. In assessing penalty, Stewards noted that Jockey Brooker had produced her phone immediately when requested, her record in relation to the rule, and her guilty plea. Jockey Brooker was subsequently advised of her rights to an appeal.
