Trainer P O’Toole pleaded to guilty to a charge under AR165(1) in that he had failed to present BALIUS on course by the prescribed time. He was subsequently fined $400 with $200 of that fine suspended for a period of two years, providing he does not breach this rule again in that period. When assessing penalty, Stewards took into account that BALIUS was presented 27 mins late on course for an event that required the runner to be on course by an hour and a half. A swab sample was also taken from BALIUS.
Stewards opened an inquiry into the reasons why three runners from Trainer P O’Toole’s stables were signed in as present on the official sign in sheet, when those runners had to yet to arrive on course. After taking initial evidence from Trainer P O’Toole and his staff, the inquiry was adjourned to a time and date to be fixed to allow Stewards to examine further evidence.
