SUPPLEMENTARY REPORT
 
From Birdsville on the 2/9/2023.
 
On 16 November 2023, Stewards enquired into an incident that took place prior to the Birdsville Cup, being the sixth race at Birdsville on the 2 September 2023, whereby apprentice Landan Sykes was engaged to ride WAITAKERE. Apprentice Landan Sykes pleaded guilty, in that he did attempt to deceive and manipulate his riding weight, when failing to include his saddle and girth during the weigh-out process, both essential components according to racing regulations. Whilst inquiring into the incident Stewards interviewed apprentice Landan Sykes, in the presence of his master, trainer Mr John Thomas. During the enquiry, audio recordings taken on the day of the incident were reviewed by all parties, and further evidence was obtained from apprentice Landan Sykes. Consequently, apprentice Landan Sykes pleaded guilty pursuant to AR 229(1)(a). Stewards considered all evidence presented and subsequently suspended apprentice Landan Sykes license to ride in races for a period of four weeks. This suspension will commence at midnight on 16 November 2023, and will conclude at midnight on 14 December 2023.
 
GENERAL
 
Stewards approved the following overweight allowances at today’s meeting -
Race 3: MR BROSE - A Best - +1kg = 56kg
 
Following a random inspection of vehicles and floats, Stewards inquired into the reason for a bottle of Gentam 100 and a syringe being brought onto the racecourse precinct by Trainer K Johnston at today’s Mt Perry race meeting. Ms Johnston explained the reason for the product and the syringe being in the vehicle was for use in case of an injury occurring to a horse at the race meeting or when travelling. Trainer Johnston stated that it had been an oversight on her part in bringing the product on course today and gave an undertaking that her runners CRAIGLEA ETNA and CRAIGLEA LAKI had not been treated leading up to the event. A pre-race swab sample was taken from CRAIGLEA ETNA.
Stewards considered all evidence presented and subsequently, Trainer K Johnston pleaded guilty to a charge pursuant to AR251(1)(b)(ii) in that she did, without written permission from Stewards, have in her possession in the vehicle used to transport the racehorses, CRAIGLEA ETNA and CRAIGLEA LAKI to the Mt Perry race meeting on Saturday 18 August 2023, a bottle of Gentam 100 which could be used to produce a prohibited substance in a horse and a syringe, which could be used to administer a prohibited substance to a horse. Trainer K Johnston was fined $500.
 
 
Race 1: BURNETT LIVESTOCK & REALTY QTIS MAIDEN PLATE 2-Y-O & Up 1000 Metres.

DUSTYIAM – Began awkwardly and lost ground. Raced at the rear of the field.
 
EMPEROR TEIO – Stewards identified the gelding to have minor abrasions to his front knees and near side hock. The gelding underwent a pre-race Veterinary examination and was passed suitable to start. Trainer B Chessher received a reprimand pursuant to AR105(d) and was reminded of his obligations to advise stewards of any condition or treatment that may affect a horse’s performance.
 
SPOT THE DOT – Began awkwardly and was slow into stride.
 
BEATLEMANIA – Began awkwardly. Laid in under pressure over the concluding stages.

LIPSTICK LIES – Slow to begin. Raced wide throughout.
 
REVITUP CHARLIE – Steadied from heels passing the 800m.
 
Race 2: RUM CITY FOODS RATINGS BAND 0 - 50 HANDICAP 1000 Metres.

AFROGINASOCK – Slow to begin and lost ground. Raced wide throughout.
 
ZENIA – Began awkwardly and made contact with the near side starting gate. Momentarily raced in restricted room approaching the 750m.
 
CREEDEMPTION – Inclined to hang out passing the 500m.
 
CONAIR – Slow to begin. Put in an awkward stride passing the 900m.
 
Race 3: NICK GIORGETTA COUNTRY STAMPEDE QUALIFIER OPEN HANDICAP 1000 Metres. 
 
MOSCINI – Began awkwardly and made contact with the offside starting gate causing the gelding to lose ground. Shifted wide passing the 400m and raced wide for the remainder of the event. Laid in under pressure in the home straight.
 
SHEEZASINGA – Jockey H Phillips reported that in her opinion the mare failed to handle carrying the extra weight on today`s firm racing surface.
 
JAMESATELLI – Began awkwardly. Shifted out making contact with the near side starting gate and lost ground. Shifted wide passing the 600m and raced wide for the remainder of the event. Laid in under pressure in the home straight.
 
MR BROSE – AS there were no other jockeys available to ride MR BROSE, Stewards permitted a request from Trainer G Richardson for Jockey A Best to ride the gelding at one kilogram over.  It was established that Trainer G Richardson and Jockey A Best had agreed to Jockey Best riding overweight, however no application had been provided to stewards. Therefore, no action was taken against Jockey Best. Trainer G Richardson was advised of the Rider Overweight Directive in that jockey overweights are to be declared through the Racing Australia Service Centre prior to the advertised jockey declaration time. Raced wide. Held up for clear running passing the 200m.
 
Race 4: R BUILDERS RATIINGS BAND 0 - 55 HANDICAP 1400 Metres.
 
The start of this race was delayed by 25 minutes after the first attempt to start the race was declared a false start by starter G Mooney acting under AR202(1)(a) in that the barriers did malfunction. Stewards interviewed Mr Mooney and inquired into what had occurred at the start and it was subsequently established that TOY BLAZE ridden by Jockey M Butler had been loaded into it`s barrier without the jockey being mounted. Whilst waiting for Jockey Butler to remount TOY BLAZE in the barriers and a clear signal to start the race to come from the assistant starter, Mr Mooney released the safety lever for the starting mechanism on the barriers in readiness to affect the start and at this point the barriers opened prematurely, and the start was not activated by Mr Mooney. Consequently, TOY BLAZE began without a rider and all other riders attempted to restrain their mounts when it was signalled to be a false start. All runners were returned to the mounting yard, unsaddled and underwent a veterinary examination to establish their fitness to rerun the race. As a result of these examinations TOY BLAZE, SINNAMON TOAST and CRAIGLEA ETNA were declared late scratching’s on vets advise after they were unable to be restrained and completed a full circuit of the track. Stewards consulted with the remaining trainers and jockeys ofthe runners which were passed suitable to start and it was decided that the race would be restarted as soon as the runners could be resaddled and arrive at the barriers. All jockeys were reweighed before the saddles were sent out to the trainers.
 
Prior to the declaration of correct weight, Stewards ordered that all bets placed on TOY BLAZE, SINNAMON TOAST and CRAIGLEA ETNA to be refunded with the following deductions to be applied to successful bets:
1st FROSTY BEAR  24c win, 46c place
2nd EMPIRE CLUB 46c place
3rd READYENTIME 46c place
 
COYOTE (NZ) – Slow to begin and trailed the field.
 
PATRICK'S ME MATE – Shifted wider passing the 600m and raced wide for the remainder of the event.
 
TOY BLAZE – Declared a late scratching at 3.42pm on vets advice, after completing a circuit of the track riderless after the false start.
 
SINNAMON TOAST –Declared a late scratching at 3.42pm on vets advice, after completing a circuit of the trackwhen unable to be restrained after the false start.
 
CRAIGLEA ETNA –Declared a late scratching at 3.42pm on vets advice, after completing a circuit of the track when unable to be restrained after the false start.
 
CANNY BOY – Declared a late scratching at 11.02am when no rider was available for the gelding. Trainer M Bailey was reprimanded pursuant to LR68(1) in that he did fail to scratch CANNY BOY by the prescribed time.
 
Race 5: EVOLUTION MINING MOUNT PERRY CUP OPEN HANDICAP 1400 Metres.
 
Due to Race 4 being declared a false start and being required to be rescheduled the start of this race was delayed until 4.30pm.
 
MR VISTA – Momentarily held up for clear running entering the home straight.
 
BUSHIDO – Raced wide throughout.
 
SALLY POPS – Jockey H Phillips reported that it was not her intension to lead but as SALLY POPS was over racing in the early stages from the wide barrier, she elected to allow the mare to stride forward and take a position outside the leader.
 
EVRYNOW'N'THEN – Slow to begin and slow to muster speed. Shifted wide passing the 500m and raced wide for the remainder of the event.
