After being advised by jockey C. McIver that he had been declared as the rider of GUISSOLA (Race 5) and RIO ROSIE (Race 7) and then had been replaced on those runners by L. Tilley and B. El-Issa respectively, stewards inquired into the matter. After hearing evidence from jockey McIver, his manager Ms A Wright, and the trainer of both horses, Mr G. Green, stewards established that jockey McIver had firm bookings for the two rides and accordingly, acting under the provisions of LR52(1), ordered that Mr Green pay jockey McIver the losing riding fee for both runners as well as any percentages earned from prizemoney for today’s races.

Stewards inquired into an incident that took place between jockeys Andrew Spinks and Bobby El-Issa in the saddling enclosure and scales area following the running of Race 6. Evidence was taken from both jockeys Spinks and El-Issa as well as the Chairman of Stewards Mr Neil Boyle, Rockhampton Jockey Club President Mr Rob Carr and jockey manager Ms Shannon Williams.

Stewards subsequently charged jockey Andrew Spinks under Rule 228(b) in that following the running of Race 6 in the vicinity of the saddling enclosure he engaged in improper conduct in that he forcibly pushed jockey B. El-Issa in the shoulder region. Jockey Spinks pleaded guilty to the charge and was fined the sum of $500. In arriving at penalty, stewards took into account the degree of physical contact from A. Spinks, his remorse and his good record under this rule over a long period of time.

Stewards also charged jockey B. El-Issa under Rule 228(b) in that following the running of Race 6 in the vicinity of the scales area he engaged in improper conduct in that he forcibly struck jockey Andrew Spinks in the back of the head with his race riding helmet. Jockey El-Issa pleaded guilty to the charge and was fined the sum of $1000. In arriving at penalty, stewards took into account the degree of physical force applied by jockey B.
