GENERAL
As Jockey B. El’Issa was unable to fulfil his engagements, stewards permitted changes as per the stewards’ race day summary.

Due to a barrier malfunction, the meeting was conducted without the use of a red light resulting in all races being hand timed.

Stewards inquired into a report relating to the conduct of Jockey Beau Appo in the jockey’s room prior to the running of race 6. After taking evidence from Jockeys Beau Appo, Nathan Thomas, Nathan Day and QRIC steward Mr. Simon Fletcher, stewards adjourned the inquiry to a time and date to be fixed.

Stewards inquired into an alleged physical altercation in the male Jockeys room between Jockeys Matthew McGillivray and Adam Sewell following the running of race 8. After taking evidence from both M. McGillivray and A. Sewell and also a report from QRIC steward Mr. Simon Fletcher, stewards issued the following charges.

Both Jockeys McGillivray and Sewell were issued with charges pursuant to AR115(1)(a);

AR 115 Jockey and apprentice jockey misconduct
(1) A jockey or apprentice jockey must not:
(a) engage in misconduct;

The particulars of Mr. Sewell’s charge being that Adam Sewell as a licensed Jockey with the Queensland racing integrity commission in the male jockeys room following the running of race 8 at the Rockhampton Jockey Club on the 29 April 2021, misconducted himself by engaging in a physical altercation with licensed Jockey Matthew McGillivray.

The particulars of Mr. McGillivray’s charge being that Matthew McGillivray as a licensed Jockey with the Queensland racing integrity commission in the male jockey’s room following the running of race 8 at the Rockhampton Jockey Club on the 29 April 2021, misconducted himself by engaging in a physical altercation with licensed Jockey Adam Sewell.

Both Jockeys plead guilty and provided further submissions in relation to penalty.

In determining an appropriate penalty in relation to the charges, Stewards considered both jockeys records, penalty precedents and the need for the penalty to act as both a specific and a general deterrent.

The Stewards, having considered the above factors, determined the appropriate penalty to be a fine of $1,000 with $500 suspended for a period of 2 years under AR283(5).

Both Adam Sewell and Matthew McGillivray were made aware of their rights to an internal review into the findings of the Stewards.
