Race 4: ROSCOS PIZZA MEMORIAL Class 1 Handicap1050 metres Prior to the declaration of correct weight, Jockey R Fradd, rider of BEYOND FATE which was placed second by the judge, lodged a protest against KINDLING SPIRIT which was placed first by the judge. After hearing submissions from Jockeys Fradd and Pike as well as the respective trainers, Stewards upheld the protest and amended the judge’s placings. In upholding the protest, Stewards considered that near the 450 metres, Jockey Pike directed his mount outwards to obtain a run outside of BORNEES LAD. As Jockey Pike was shifting outwards, TOP CEEDEE commenced to shift outwards which forced BORNEES LAD wider on the track. Jockey Pike continued to allow his mount to shift outward which resulted in BEYOND FATE being checked and losing ground. Stewards were opined that should the interference had not have happened, BEYOND FATE would have beaten KINDLING SPIRIT. At a subsequent inquiry, Jockey W Pike was found guilty of a charge of careless riding under AR131(a) in that he directed his mount outwards when insufficiently clear of BEYOND FATE which resulted in that runner being checked and losing ground.
