SUPPLEMENTARY REPORT

From SCTC 21.5.17 – Race 3: Stewards today concluded an inquiry into the handling of BUNGLE BOORI. Further evidence was taken from co-trainer John Symons and jockey M. Hellyer, and also evidence was tabled in relation to the horse’s previous starts and evidence was tendered by the owners of the mare. Stewards also provided evidence into the analysis of the wagering on the event in the form of a statement from betting supervisor Mr M. Heffernan. Stewards, in inquiring into jockey Hellyer’s riding, were concerned with his actions from leaving the 450m onwards and his lack of vigour during that portion of the event. Jockey Hellyer explained that after having improved on to heels near the 600m, he had been required to restrain BUNGLE BOORI and the mare had commenced to hang out, which has been a trait of BUNGLE BOORI in the past. He indicated that he was unable to test the horse at all during the first 300m of the home straight as the horse continued to hang out and the horse did improve its manners over the final 100m, however he was still at a disadvantage. He added that after the winning post the horse hung out to the outside fence despite his efforts at that point.

Stewards noted that the horse has previously been barred for hanging out during an official trial prior to its first start and does wear a lugging bit to combat this trait. Stewards found that whilst they accepted that the hose had commenced to hang out after the 500m, they had reservations as to how significant the horse’s tendency to hang out had been. In analysing the race footage, stewards also believed that jockey Hellyer’s evidence was somewhat supported , however did have some doubts as to the extent the horse hung in the home straight. Stewards were ultimately satisfied that any doubt should be afforded to jockey Hellyer and ruled that BUNGLE BOORI would be required to officially trial prior to its next race start. Jockey Hellyer was subsequently charged and pleaded guilty under AR. 140(b) in that he failed to notify stewards of BUNGLE BOORI’s tendency to hang prior to the inquiry being opened. Jockey Hellyer was fined $400.
