SUPPLEMENTARY REPORT
Townsville May 27, 2021
Race 6. SKY RACING OPEN HANDICAP 1000m
Stewards today inquired into the reason MOLONGLE MAGIC (D Smith) had to be restrained in the vicinity of the 100m. After hearing evidence from Jockey Smith and Jockey C Whiteley who rode FULL RECOGNITION, viewing patrol footage, and based on their own observations, Stewards established that approaching the 100m FULL RECOGNITION had improved to the outside of MOLONGLE MAGIC, when inclined to lay in under hard riding, resulting in crowding to that runner which had to be restrained. As Stewards were of the opinion Jockey Whiteley could have made a greater effort to straighten his mount sooner, he was severely reprimanded for careless riding under the provisions of AR131(a).
Stewards today inquired into the reason App K Swaffer was dislodged from her mount OUR ALICIA’S LANE, and MOLONGLE MAGIC was inconvenienced approximately 80m from the winning post. After hearing evidence from App Swaffer, in the presence of her master Mr T Rowe, and Jockeys B Pengelly (BEAU JET), C Whiteley (FULL RECOGNITION) and D Smith (MOLONGLE MAGIC), viewing patrol footage, and based on their own observations, Stewards issued a charge of careless riding under the provisions of AR131(a) against Jockey Pengelly. The specifics being that “passing the 100m, he permitted BEAU JET to shift out under hard riding onto the running of OUR ALICIA’S LANE (App K Swaffer) when insufficiently clear to do so, resulting in OUR ALICIA’S LANE blundering and dislodging App Swaffer. MOLONGLE MAGIC which was following was inconvenienced in attempting to avoid the fallen rider.”
Although Stewards did note that FULL RECOGNITION which had improved to the outside of OUR ALICIA’S LANE had been inclined to lay in under pressure prior to the incident, they were of the opinion that this had no bearing on the incident as OUR ALICIA’S LANE, as evidenced by patrol footage, both head-on and direct rear view, had maintained a true course once it had established a run to the outside of BEAU JET, and did not have its running dictated in any way by FULL RECOGNITION. Stewards were also mindful that Jockey Pengelly had complained of neck soreness at the scales immediately following the race, and at his request, was stood down after advising of his inability to fulfil his remaining engagement. After further viewing of the patrol footage, and considering the fervent vigour displayed by Jockey Pengelly over the concluding stages of the event, Stewards could not be satisfied that he was experiencing any physical impairment either prior to or following the incident.
Jockey Pengelly pleaded not guilty to the charge and was afforded the opportunity to make submissions in defence.
After considering Jockey Pengelly’s submissions, Stewards were satisfied that the charge could be sustained and he was found guilty. Jockey Pengelly’s licence to ride in ride in races was suspended for a period of 4 weeks to commence Sunday August 1st, 2021 up to and including Saturday August 28, 2021. In assessing penalty Stewards were considerate of Jockey Pengelly’s good record in relation to careless riding, however were extremely mindful of the degree of carelessness and interference in the incident, both of which were deemed to be in the high range.
Jockey Pengelly was advised of his right to refer the matter to the Internal Reviewer.
