SUPPLEMENTARY REPORT

Toowoomba 3rd December 2022

Race 6- HAPPY 50th ANDREW WILSON MAIDEN PLATE 1200m

Stewards resumed an inquiry into the reasons SLINKY’S STAR shifted out and was restrained near the 150m. After taking further evidence from Trainer L Hatch Stewards issued App J Molloy with a severe reprimand under the provisions of AR131(a) in that he did shift out when not fully clear of SLINKY’S STAR causing that runner to be taken wider and restrained. Stewards noted the racing manners of SLINKY’S STAR throughout the event and viewed this as a mitigating circumstance when considering the severity of the interference. Stewards also noted marginal shifts in and out from SLINKY’S STAR and BETTER THAN ROSES (N Tomizawa) in the moments prior to the incident which were considered to be contributing and mitigating factors when considering App Molloys culpability.

GENERAL

Stewards permitted the following overweights at todays meeting:

Race 2- Jockey G Geran +0.5kg
Race 4- App J Molloy +1kg
Race 5- Jockey N Fazackerley +0.5kg

Stewards inquired into an incident which occurred prior to the running of Race 5 in the vicinity of the entrance to the ‘Winners ‘Bar’. After taking evidence from the persons involved and witnesses to the incident Trainer Ms Michelle Labahn was issued with a charge pursuant to AR228(b) in that she did misconduct herself by making physical contact with Trainer Mr Josh Morrow when attempting to secure his phone from his person whilst attempting to engage in a verbal altercation with Mr Morrow. Ms Labahn was subsequently fined the sum of $500, $300 of which was wholly suspended for a period of 12 months. In determining penalty Stewards considered Ms Labahn’s guilty plea, her excellent record in relation to the rule and her forthright evidence as well as the negative impact incidents such as these have on the industry as a whole and the need to any penalty to act not only as a specific deterrent but to the industry cohort as a whole.

Race 1: REDDING FRY FINANCIAL ADVICE RATINGS BAND 0-58 HANDICAP 1200m

Declaration of correct weight was delayed to allow Jockey G Geran, rider of 2nd placegetter DREAMSEEKER, to view patrol footage of the concluding stages. Trainer C Geran advised the stable had expected a better performance and further undertook to advise should anything become apparent regarding the fillies condition going forward.

After taking evidence from the riders and connections of both runners and viewing the patrol footage Stewards determined that LA BREA had laid out leaving the 100m and bumped CHOCOLATIER before being corrected by its rider. Taking this into account as well as the manner in which both runners finished the race off and the beaten margin Stewards could not be comfortably satisfied that the interference had any tangible effect on the placings and as such dismissed the protest and declared correct weight on the Judges placing.

PAST TENSE- After reviewing the patrol footage it was determined the gelding stood flat footed and refused to exit the barrier taking no competitive part in the race.
