QUEENSLANDRACING INTEGRITY COMMISSION STEWARDS REPORT TOOWOOMBA – TOOWOOMBA TURF CLUB TOOWOOMBA - SATURDAY 17, AUGUST 2024 WEATHER – FINE TRACK RATING – SOFT 5 RAIL – Out 4metres the entire OFFICIALS Chairman of Stewards – C. WarrenStewards – J. Childs, F. Hartford, C. Taylor & E. Tickner SUPPLEMENTARY REPORT TOOWOOMBA TURF CLUB - SATURDAY 10 AUGUST 2024 Race 7: SHERRIN RENTALS QTIS THREE-YEAR-OLD BENCHMARK 60 HANDICAP (1100m) MISHANI STORM – Stewards concluded an inquiry into App Dylan Bennett’s riding of the filly near the 550m, whereby his elbow became elevated in the immediate vicinity of another rider. After taking further evidence from Jockey L Tilley (ROCKY RICH), App Bennett and his Master, Trainer Lindsay Hatch, and reviewing the available footage further, Stewards issued Apprentice Bennett with a charge of improper riding pursuant to AR131(a) the particulars being that App Bennett did ride in an improper manner in that passing the 550m he did direct his mount out, under riding, in a deliberate and intentional act to shift ROCKY RICH (L Tilley) wider to obtain clear running for his own mount so as to improve his position and in doing so did raise his elbow upwards and outwards towards Jockey L. Tilley and appear to make contact with him in doing so. App Bennett pleaded not guilty to the charge and made further submissions to that effect. After considering those, Stewards ultimately found App Bennett guilty and after taking submissions concerning penalty determined a suspension of App Bennetts license to ride in races for a period of 16-days was warranted, to commence 18 August 2024 up to and including 2 September 2024. In considering the matter Stewards noted App Bennetts relative inexperience with less than 300 career race rides as an apprentice, his record in relation to the rule, the minor nature of the interference caused to ROCKY RICH and Jockey L. Tilley given that runner was able to maintain its position and App Bennetts general good character, as well as the objectively serious nature of the breach given the risk such actions pose to safety of both horse and rider which are at all times paramount, the need for both specific & general deterrence as well as relevant penalty precedents noting a starting point of three (3) to four (4) weeks suspension as a matter of course for similar breaches. App Bennett was advised of his right to an appeal. DOOMBEN - SATURDAY 17 AUGUST 2024 App S Callow was fined the sum of $100 under the provisions of AR127(1) for failing to fulfil her engagements in Races 8 & 9 at Doomben. Once Jockey Tarrant and Stewards were similarly satisfied that there were no grounds for objection, correct weight was declared on the Judges semaphored numbers. HEROIC OSCAR – Momentarily held-up for clear running approaching the 300m before being shifted wider. Steadied leaving the 300m when MISS BIITERSWEET shifted in when not fully clear. LA MANO- Stable Foreman K Zahmel advised Stewards that a forward showing had been expected with the mare pleasing in its work leading into the event and noted the interference suffered in its most recent start was a telling factor in that performance. Mr Zahmel further noted that the mare performs best when able to obtain a forward position as it did on this occasion. MISS BIITTERSWEET – Improved onto heels near the 300m before being shifted in. N. Tomizawa pleaded guilty to a charge of careless riding in that leaving the 300m, he directed his mount in across the line of HEROIC OSCAR which was obliged to steady when losing its rightful running. Jockey Tomizawa’s license to ride in races was suspended for 7 days to commence 22 August 2024 up to and including 28 August 2024. In considering penalty, Stewards considered the interference and carelessness to be in the low and mid-range respectively, Jockey Tomizawa’s excellent recent record in relation to the rule and his guilty plea. Jockey Tomizawa was advised of his rights to an appeal. Approaching the 200m laid in and away from another runner, momentarily crowding KRAKEN EDITION. PROPHET OF BOOM – Jockey K.
