SUPPLEMENTARY REPORT
Queensland Racing Integrity Commission (QRIC) Stewards today inquired into a report from the analysis of a urine sample provided by licensed Jockey Wanderson D’Avila when he rode at the Atherton Jockey Club on 6 March 2021. The urine sample contained a banned substance above the permitted threshold under AR136 (1). When deciding to issue a charge under AR139 (1) (a), the Stewards were of the opinion that Mr D’Avila failed to make the appropriate application for an exemption to ride with this medication set out clearly in AR142. AR139 (1) (a) reads: A rider breaches these Australian Rules if a banned substance under AR136 (1) is detected in a sample taken from the rider. The specifics of the charge being that Mr D’Avila did provide a sample of urine at the Atherton Jockey Club on 6 March 2021, which contained a banned substance under AR136 (1) above the permitted threshold. In determining penalty, Stewards were mindful of the circumstances of this particular case, Mr D’Avila’s forthright evidence, guilty plea and relevant penalty precedents. Subsequently, Mr D’Avila had his right to ride suspended for a period of four (4) weeks which commenced from 26 March 2021, when originally stood down and to expire at midnight 26 April 2021. Mr D’Avila was further advised it is a requirement that he supply a urine sample free of any banned substances prior to his licence being reinstated in full, allowing him to ride again. Mr D’Avila was advised of his rights to an internal review.
