PROUDDS SEQUEL On return to scale, N. Tomizawa reported that his mount may not have been afforded a fair start. In consultation with jockey Tomizawa and trainer M. Frappellls stable representative and after viewing the head-on patrol footage of the start, stewards were satisfied that the barrier gates of PROUDDS SEQUEL failed to activate in unison with the gates of other runners, resulting in the horse not being afforded a fair start. Accordingly, acting under the provisions of AR. 134A, stewards declared PROUDDS SEQUEL a non-starter and amended the Judgees placings to: 4, 8, 1 and 7. Stewards ordered that all monies invested on PROUDDS SEQUEL be refunded, with the following deductions to apply to successful wagers:

4 cents in the dollar for the win #4
4 cents in the dollar for place of winner 4
8 cents in the dollar for 2nd place #8

Race 3: BUTLER MCDERMOTT LAWYERS BENCHMARK 55 HHCAP 1900M

Prior to the running of this event the starter reported that the barrier gates had been retested and found to be in working order.

On return to scale M. Pegus, the rider of VALHALLA MIST, placed 2nd by the Judge, lodged an objection against TIMELY REMINDER (R. McMahon) being declared the winner, alleging interference near the 500m. After taking evidence from all parties concerned and viewing the stewardss patrol footage, it was established that near the 500m TIMELY REMINDER had shifted 11 horses away from the rail, which afforded a run to VALHALLA MIST to its inside. However, shortly after, R. McMahon allowed TIMELY REMINDER to shift back in, tightening the running of VALHALLA MIST, which had to be checked and lost its position. Stewards were of the opinion that the ground lost by VALHALLA MIST in the incident exceeded the margin of half a length separating both runners at the finish and therefore upheld the objection and declared correct weight on the amended placings of 4, 8, 6 and 3.

At a subsequent inquiry, R. McMahon was found guilty of a charge of careless riding under AR. 137(a) in that approaching the 450m he permitted his mount to shift in, resulting in VALHALLA MIST being checked and losing its rightful running. Jockey McMahonns licence to ride in races was suspended for a period of 10 days, to commence at midnight on Saturday 4 November and expire at midnight on Tuesday 14 November 2017.

PRINCE OF BARODA Slow to begin. Improved three wide from the 1500m to a position outside the leader near the 1200m.

KID CRUIZE Hung in approaching the 450m.

LAUDABLE LEMON Slow to begin.
